James Bay wins

Railway succeeds in setting aside G.T.R's order regarding brickyard switch.

Ottawa, Feb. 1.—The Railway Commission yesterday heard the application of the James Bay Railway Co., supported by the C.P.R., to set aside the order granted a year ago to the Grand Trunk giving the latter power to build a spur line from the Toronto belt system to the Davies brickyard. The Chairman, after hearing argument from all concerned, gave judgment rescinding the order in so far as the James Bay Railway is concerned, on the ground that it was made without the required notice, without the filing of plans, and on a misrepresentation, which doubtless was unintentional.
