In the matter of the application of the City of Kitchener, in the Province of Ontario, hereinafter called the
Applicant, under Section 257 of the Railway Act, for leave to widen the crossing of the Canadian National Railways at Ottawa Street (formerly South Street), in the City of Kitchener, Province of Ontario, from forty feet to sixty-six feet:

Upon reading what has been filed on behalf of the Railway Company, and the report and recommendation of the Chief Engineer of the Board—
It is ordered
- That the Applicant be, and it is hereby, authorized, at its own expense, to widen the said crossing of the Canadian National Railways on Ottawa (formerly South) Street, in the City of Kitchener, Province of Ontario, from forty feet to sixty-six feet, as shown on plan dated Kitchener, March 8th, 1939, on file with Board under File No. 40261, and in accordance with the Standard Regulations of the Board Affecting Highway Crossings.
- That the cost of maintaining the said crossing be borne and paid by the Canadian National Railways, as provided under the Order of the Board No. 55105, dated 1st November, 1937.
