In the matter of the application of the Canadian National Railway Company for an Order authorizing abandonment of operation of that part of the Maynooth Subdivision between Bird's Creek, mileage 90.20 and Wallace, mileage 117.57, in the Province of Ontario, a total distance of 27,37 miles:

Upon hearing the application at a sittings of the Board held at Bancroft, Ontario, on the 8th day of July, 1965, in the presence of Counsel for the Canadian National Railway Company, and for the Townships of Carlow; Mayo; Dungannon; Faraday; Monteagle; Herschel; Limerick; Wollaston; Bangor, Wicklow and McClure; the Village of Bancroft; the Bancroft and District Chamber of Commerce; Mr. Robert Temple, M.P.; Mr. Clark Rollins, M.L.A.; Warden Beckett of Hastings County, and various businessmen, residents and clergymen of the District;

Whereas Counsel for the Canadian National Railway Company, with the consent of Counsel for those opposed, withdrew as a candidate for an abandonment Order at this time that portion of the Maynooth Subdivision between Bird's Creek, mileage 90.20, and Lake St. Peter, mileage 109.84, thus reducing the length of trackage for which abandonment was being sought to 7.73 miles of the Maynooth Subdivision, being that portion between Lake St. Peter at mileage 109.84 and Wallace at mileage 117.57;

And pursuant to oral judgment given at the hearing—

It is hereby ordered as follows:

  1. The Canadian National Railway Company is authorized to abandon operation of that portion of its Maynooth Subdivision between Lake St. Peter, mileage 109.84, and Wallace, mileage 117.57, a distance of 7.73 miles.
  2. The said abandonment of operation may take place any time after the 15th day of August, 1965, upon thirty days' prior notice filed with the Board and posted in the Company's stations at Lake St. Peter, Maynooth, Bancroft and Whitney.
  3. The Canadian National Railway Company shall advise the Board that abandonment of operation has taken place within one week of such abandonment.
