In the matter of the application of the City of Waterloo, in the Province of Ontario, hereinafter called the Applicant, for authority to reconstruct Northfield Drive where it crosses at grade the track of the Canadian National Railways in the City of Waterloo, in the Province of Ontario, at mileage 4.73 Waterloo Subdivision (Elmira Branch):

Upon reading the submissions filed—

It is hereby ordered as follows:

  1. The Applicant is authorized to reconstruct Northfield Drive where it crosses at grade the track of the Canadian National Railways in the City of Waterloo, in the Province of Ontario, at mileage 4.73 Waterloo Subdivision (Elmira Branch), by widening and improving the approaches to the said crossing.
  2. The said crossing shall be reconstructed in compliance with the Requirements of the Board Affecting Highway Crossings.
  3. Eighty per cent of the cost of improving the east approach to said crossing to provide a level portion twenty-five feet long adjacent to the track, connected by a suitable vertical curve to a five per cent ascending gradient beyond, for an approach having a travelled width of twenty-two feet with a two-foot shoulder on each side, or the sum of $800.00, whichever is the lesser, shall be paid out of The Railway Grade Crossing Fund, seven and one-half per cent shall be paid by the Canadian National Railways, and the balance of the said cost shall be borne and paid by the Applicant.
  4. The cost of improvements to the west approach grade to the said crossing, as well as the cost of improvements additional to those described in paragraph numbered 3 of this Order, shall be borne and paid by the Applicant.
  5. The cost of maintenance of the said reconstructed crossing shall be borne and paid by the Canadian National Railways.
