In the matter of the application of the City of Waterloo, in the Province of Ontario, hereinafter called the Applicant, for authority to relocate Dearborn Street West where it crosses the right of way of the Canadian National Railways in the City of Waterloo, Province of Ontario, as shown on Plan No. 8-49, dated March 1959, on file with the Board under file No. 26711.1443:

Upon reading the submissions filed—

It is hereby ordered as follows:

  1. The Applicant is authorized to relocate Dearborn Street West where it crosses the right of way of the Canadian National Railways in the City of Waterloo, Province of Ontario, as shown on the said plan on file with the Board under file No. 26711.1443.
  2. The said crossing shall be constructed in accordance with the Standard Regulations of the Board Affecting Highway Crossings.
  3. The cost of relocating the said crossing shall be paid by the Applicant, and the cost of maintenance of the said relocated crossing shall be borne and paid fifty per cent by the Applicant and fifty per cent by the Canadian National Railways.
