In the matter of the application of the Corporation of the City of Brantford, in the Province of Ontario, hereinafter called the Applicant, for leave to construct a subway under the Canadian National Railways on West Street, and to close George Street as shown on the plan and profile dated Brantford, October 6, 1928, on file with the Board under file No. 26765.102.

Upon hearing the application at the sittings of the Board held in Toronto, November 14, 1928, in the presence of counsel for the applicant and the railway company, and what was alleged,—

The Board orders:

  1. That the applicant be, and it is hereby, granted leave to construct a subway under the tracks of the Canadian National Railways on West street, in the city of Brantford, province of Ontario, and to close George street, as shown on the said plan and profile on file with the Board under file No. 26765.102; detail plans to be filed for the approval of an engineer of the Board; and the work to be commenced within one year and completed within two years from the date of this order.
  2. That forty per cent of the cost of constructing the said subway, not exceeding, however, the sum of $100,000, be paid out of the Railway Grade Crossing Fund, forty per cent to be paid by the Canadian National Railways, and twenty per cent by the applicant; the cost of maintaining the street surface, pavement, and sidewalks, including drainage and lighting, to be borne and paid by the applicant, the remainder of the cost of maintenance to be at the expense of the railway company.
  3. That the said George street be closed after the construction of the proposed subway is completed.
