Yonge Street bridge, Toronto.—The claim filed by the C.P.R. in connection with the application to set aside the order for the construction of a bridge across the railway tracks at the foot of Yonge St., Toronto, asks the court to declare that the order is invalid because the Esplanade agreement is the subject of special legislation; and for other reasons, the most important being that the railway does not cross Yonge St.; that the G.T.R. having been given the power to run on the level of the Esplanade, there is no power to order another street to be carried across the Esplanade; and further that the Railway Committee had no jurisdiction to order damages to be paid by the railway companies.
